About the Act
SB 177 Homeless Youth Education Success Act.
This act amends California Education Code section (Ca. Educ. Code §) 48850 with regards to ensuring educational access for children and youth experiencing homelessness, including access to extracurricular and enrichment activities, access to immediate school enrollment, and ensuring that child abuse and neglect reporting requirements do not create a barrier to school engagement. The act also adds Ca. Educ. Code § 48852.5 with regards to the public notice of the educational rights of children and youth experiencing homelessness in schools.
Ca. Educ. Code § 48850 (Educational Access)
- Educators, county placing agencies, care providers, advocates, and the juvenile courts shall work together to maintain stable school placements for students experiencing homelessness, and to ensure that students experiencing homelessness are placed in the least restrictive educational programs and have access to the academic resources, services, and extracurricular and enrichment activities that are available to all students, including, but not necessarily limited to, interscholastic sports administered by the California Interscholastic Federation.
- Students experiencing homelessness shall be immediately deemed to meet all residency requirements for participation in interscholastic sports or other extracurricular activities.
- Public schools, including charter schools, and county offices of education (COEs) must enroll students experiencing homelessness in school immediately.
- The California Department of Education and Department of Social Services shall develop policies and practices to support homeless children and youths and to ensure that child abuse and neglect reporting requirements do not create barriers to the school enrollment and attendance of homeless children or youths, including, but not limited to, ensuring that a pupil who is a homeless child or youth is not reported to law enforcement by school personnel if the sole reason for the report is the pupil’s homelessness.
Ca. Educ. Code § 48852.5 (Public Notice of Educational Rights)
- LEA liaisons shall ensure that public notice of the educational rights of homeless children and youths is disseminated in schools within the liaison’s LEA.
