About the Act

AB 408 Homeless children and youths: reporting.

This act adds Ca. Educ. Code § 48851.3 with regards to local educational agency (LEA) homeless education program policies and LEA liaison homeless education training offerings, and adds Ca. Educ. Code § 48852.3 with regards to California Department of Education (CDE) monitoring of LEA compliance with AB 408, as outlined below.

Ca. Educ. Code § 48851.3 (LEA Homeless Education Policies and Training Offerings)

  • LEAs — defined to include a school district, county office of education (COE), charter school, or special education local plan area (SELPA) — shall
    • Establish homeless education policies that are consistent with state law and update these policies at intervals that shall not exceed three years.
    • Use resources developed by CDE and CDE's Homeless Education Technical Assistance Center (HETAC).
  • LEA homeless liaisons shall
    • offer training at least annually related to
      • the LEA's homeless education program policies.
      • recognizing signs that pupils are at-risk of or experiencing homelessness.
    • offer the above training to LEA certificated and classified employees providing services to pupils experiencing homelessness, including, but not limited to, teachers, support staff, and other school staff who work with pupils
    • inform the above certificated and classified employees of the availability of training and the services the LEA liaison provides to aid in the identification of and provision of services to pupils at-risk of or experiencing homelessness.

Ca. Educ. Code § 48852.3 (CDE Monitoring of LEA Compliance)

  • CDE shall implement risk-based monitoring of LEAs that shall include, but not be limited to, schoolsite inspections to ensure that the state is not underestimating the number of youth experiencing homelessness.

Legislation
