About the Act

AB 1567 Before and after school programs: enrollment: fees: homeless and foster youth: snacks or meals.

This act adds California Education Code sections (Ca. Educ. Code §§) 8482.6 with regards to eligibility and fees for California's After School Education and Safety (ASES) programs, and 8483 with regards to enrollment priority for California's ASES programs, as outlined below.

Cal. Educ. Code § 8482.6 (Eligibility and fees)

  • Every student attending a school operating a California's After School Education and Safety (ASES) program is eligible to participate in the program, subject to program capacity. ASES programs are not required to charge family fees or conduct individual eligibility determinations based on need or income. If an ASES program does charge family fees, the program shall not charge a fee for students experiencing homelessness.

Cal. Educ. Code § 8483 (Enrollment priority)

  • First priority for enrollment in ASES programs will go to students experiencing homelessness at the time they apply for enrollment or at any time during the school year.
  • Nothing in this statute shall be construed to require a program to verify, or a school district to disclose to an after school program, that a student applying for or participating in the program is experiencing homelessness.
  • Nothing in this statute shall be construed to require or authorize the disenrollment of a current ASES program participant in order to secure the enrollment of a student who has priority for enrollment.
  • ASES programs will inform the parent or caregiver of a student of the right of students experiencing homelessness to receive priority enrollment and how to request priority enrollment.
  • For purposes of identifying students who are eligible for priority enrollment in ASES programs, program administrators will allow self-certification of students experiencing homelessness. Administrators also may obtain this information through the school district homeless liaison if the school district has a wavier on file allowing for the release of this information.
